Welcome to ServantRecordings.com (the “Site”), owned and operated by Servant Recordings (“we,” “us,” “our”). These Terms of Service (“Terms”) govern your access to and use of the Site, including all content, features, services, and functionality offered on or through the Site. By accessing, browsing, or using the Site in any manner, you acknowledge that you have read, understood, and agree to be bound by these Terms.
By accessing or using the Site, purchasing any service, making a donation, submitting any content, or otherwise engaging with Servant Recordings through the Site, you agree to be legally bound by these Terms, as well as our Privacy Policy, which is incorporated herein by reference. If you do not agree to these Terms in their entirety, you must immediately discontinue all use of the Site and refrain from accessing any of our services.
You represent and warrant that you are at least eighteen (18) years of age and have the legal capacity to enter into a binding agreement. If you are accessing the Site on behalf of an organization or entity, you represent and warrant that you have the authority to bind that organization or entity to these Terms.
Your continued use of the Site following the posting of any changes to these Terms constitutes your acceptance of those changes. We encourage you to review these Terms periodically.
Servant Recordings provides the following services through the Site (collectively, the “Services”):
We offer original contemporary Christian music singles, including but not limited to “Do Not Fear,” “I AM,” “I Have Not Forgotten You,” and “The Flame,” available for free streaming and/or download, subject to the license restrictions set forth in Section 3 below.
We offer a custom recording service wherein users may submit personal stories, details, and preferences, and we will compose original lyrics and produce a professionally recorded song based on the submitted material. This service is offered at the price listed on the Site at the time of purchase, subject to the terms set forth in Section 4 below.
We accept voluntary donations from users who wish to support our ministry, subject to the terms set forth in Section 5 below.
We provide a contact form through which users may submit messages, inquiries, and prayer requests. Submission of prayer requests and other messages is subject to the terms set forth in Section 6 below.
All content on the Site, including but not limited to all original music, lyrics, sound recordings, musical compositions, album artwork, graphic designs, photographs, text, logos, trademarks, service marks, trade dress, and the overall look and feel of the Site (collectively, “Our Content”), is the exclusive property of Servant Recordings or its licensors and is protected by United States and international copyright, trademark, and other intellectual property laws. All rights not expressly granted herein are reserved.
Subject to your compliance with these Terms, we grant you a limited, non-exclusive, non-transferable, non-sublicensable, revocable license to stream and/or download our free music singles solely for your personal, non-commercial use. This license does not include, and you shall not engage in, any of the following without our prior written permission:
We reserve the right to revoke this license at any time, for any reason, in our sole discretion.
Servant Recordings retains full copyright ownership and all intellectual property rights in and to all custom recordings, including but not limited to the musical composition, lyrics, sound recording, arrangement, and all associated creative elements. The purchase of a custom recording does not transfer copyright or ownership of any kind to the buyer.
Upon full payment and delivery, the buyer receives a limited, non-exclusive, non-transferable, personal-use license to listen to, share privately with friends and family, and use the custom recording for personal, non-commercial purposes only. The buyer may not, without our prior written consent:
Portfolio and Promotional Use: Servant Recordings reserves the right to use any custom recording, in whole or in part, in our portfolio, promotional materials, marketing campaigns, social media, demo reels, future releases, compilations, or for any other purpose, at our sole discretion. When using custom recordings for such purposes, we will remove or alter any identifying personal details (names, specific dates, locations) to protect your privacy, unless you provide explicit written consent for the use of such details. By ordering a custom recording, you acknowledge and agree to this right.
You may not copy, reproduce, distribute, transmit, display, perform, publish, license, create derivative works from, transfer, or sell any information, content, software, products, or services obtained from the Site without our prior written permission.
All custom recording orders are confirmed upon successful receipt of payment. The current price for a custom recording is listed on the Site at the time of purchase. Payment is processed through our third-party payment processor, Stripe, and is subject to the additional terms set forth in Section 7 below. Your order is not confirmed, and we have no obligation to begin work, until payment has been successfully processed and received.
We estimate that custom recordings will be delivered within seven (7) to fourteen (14) business days from the date of order confirmation. This timeline is an estimate only and is not a guarantee. Delivery times may vary based on order volume, complexity of the request, revision requests, and other factors. We will make commercially reasonable efforts to deliver your recording within the estimated timeframe, but we shall not be liable for any delays in delivery. “Business days” means Monday through Friday, excluding United States federal holidays.
One (1) round of revisions is included with every custom recording order. A “round of revisions” consists of a single set of feedback or change requests submitted by the buyer after delivery of the initial recording. Revision requests must be submitted within fourteen (14) days of delivery of the initial recording. Additional revisions beyond the included round may be available at our discretion and may be subject to additional fees.
We reserve the right to decline any custom recording request, at any time, at our sole and absolute discretion, with or without cause. Reasons for declining may include, but are not limited to, content that we deem inappropriate, offensive, inconsistent with our values and mission, or otherwise objectionable. If we decline a request for which payment has already been received, we will issue a full refund of the amount paid.
All content submitted by users in connection with a custom recording request, including but not limited to stories, personal details, names, Scripture references, and other materials (“User Submitted Content”), must comply with the following requirements. User Submitted Content must not:
By submitting content in connection with a custom recording request, you represent and warrant that: (a) you are the rightful owner of the story, details, and all other material you submit, or you have obtained all necessary permissions, consents, and licenses to share such material with us; (b) the submitted content does not and will not infringe upon or violate the rights of any third party; (c) all information you provide is truthful and accurate to the best of your knowledge; and (d) you have the legal right and authority to grant us the rights described in these Terms with respect to the submitted content.
Refunds will be processed through the original payment method and may take five (5) to ten (10) business days to appear on your statement, depending on your financial institution.
All donations made through the Site are entirely voluntary gifts. Donations are not payments for services, are not purchases, and do not create any contractual obligation on the part of Servant Recordings to provide any specific product, service, or benefit unless explicitly stated as a specific benefit of a particular donation tier at the time of the donation.
All donations are final and non-refundable. By making a donation, you acknowledge and agree that your donation is a voluntary gift and that you will not seek a refund, chargeback, or reversal of the donation for any reason. If you believe a donation was made in error (e.g., an unauthorized transaction), please contact us at [email protected] and we will work with you to investigate the matter.
Certain donation tiers may include associated perks or benefits (such as devotionals, prayer circle inclusion, early access to new music, behind-the-scenes updates, personal thank-you recordings, or other benefits as described on the Site at the time of donation). These perks are provided at our sole discretion and may be modified, substituted, or discontinued at any time without notice. The specific nature, timing, and manner of delivery of any donation perks are determined by us in our sole discretion.
The Cornerstone donation tier ($100) includes a custom song as a stated benefit. This custom song benefit is subject to all terms and conditions applicable to the Custom Recording Service as set forth in Section 4, including but not limited to our intellectual property rights (Section 3.3), content requirements (Section 4.5), right to decline (Section 4.4), and delivery timeline (Section 4.2). The custom song included with the Cornerstone tier is provided as a gift in recognition of the donation and does not alter the voluntary, non-refundable nature of the underlying donation.
Servant Recordings does not provide tax advice. It is your sole responsibility to determine the tax implications, if any, of your donation. We make no representations or warranties regarding the tax deductibility of any donation. Consult your own tax advisor for guidance.
By submitting any content to us through the Site, including but not limited to stories, personal details, prayer requests, messages, feedback, testimonials, photographs, and any other materials (collectively, “User Submissions”), you grant Servant Recordings a non-exclusive, royalty-free, perpetual, irrevocable, worldwide, fully sublicensable license to use, reproduce, modify, adapt, publish, translate, create derivative works from, distribute, perform, and display such User Submissions, in whole or in part, in any form, media, or technology now known or hereafter developed, for the purpose of providing, improving, and promoting our Services. This license survives termination of these Terms or your use of the Site.
We are under no obligation to use, publish, respond to, or take any action with respect to any User Submission. We reserve the right, but have no obligation, to monitor, edit, remove, or refuse to accept any User Submission for any reason or no reason.
We are not responsible for the accuracy, truthfulness, completeness, or reliability of any User Submission. Users are solely responsible for the content they submit. We do not verify, endorse, or adopt any User Submission as our own.
We may use anonymized, adapted, or fictionalized versions of User Submissions, including stories submitted in connection with custom recording requests, in our promotional materials, website content, social media, testimonials, marketing campaigns, and other communications. By submitting content to us, you consent to such use. We will make reasonable efforts to remove identifying personal details from any User Submission used for promotional purposes, unless you have provided explicit written consent to the use of your name, likeness, or other identifying information.
Prayer requests submitted through the Site are received and handled with care and confidentiality. However, by submitting a prayer request, you acknowledge that: (a) we cannot guarantee any specific outcome or result from prayer; (b) prayer requests may be shared within our internal prayer team; and (c) we are not providing professional counseling, medical advice, or any form of licensed professional service through the receipt of prayer requests.
All payments made through the Site, including custom recording purchases and donations, are processed by Stripe, Inc. (“Stripe”), a third-party payment processor. By making a payment through the Site, you agree to be bound by Stripe’s terms of service and privacy policy, available at stripe.com/legal. We do not store your full credit card information on our servers. All payment data is handled directly by Stripe in accordance with their security standards.
All prices displayed on the Site are in United States Dollars (USD). Prices for our Services are subject to change at any time, without prior notice. The price in effect at the time of your purchase or donation will apply to your transaction. We are not obligated to honor pricing errors or discrepancies.
From time to time, we may offer promotional pricing, discounts, or coupon codes. All promotional pricing is available for a limited time at our sole discretion and may be modified or withdrawn at any time without notice. Promotional pricing cannot be combined with other offers unless expressly stated. We reserve the right to limit the number of transactions eligible for promotional pricing.
You are responsible for any applicable taxes associated with your purchase or donation. Prices listed on the Site may not include applicable sales tax, use tax, or other governmental charges. Any such taxes are your sole responsibility.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL SERVANT RECORDINGS, ITS OWNERS, OPERATORS, DIRECTORS, OFFICERS, EMPLOYEES, AGENTS, CONTRACTORS, PARTNERS, AFFILIATES, SUCCESSORS, OR ASSIGNS (COLLECTIVELY, THE “SERVANT RECORDINGS PARTIES”) BE LIABLE TO YOU OR ANY THIRD PARTY FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, PUNITIVE, OR EXEMPLARY DAMAGES, INCLUDING BUT NOT LIMITED TO DAMAGES FOR LOSS OF PROFITS, GOODWILL, USE, DATA, OR OTHER INTANGIBLE LOSSES, ARISING OUT OF OR IN CONNECTION WITH:
WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), STRICT LIABILITY, OR ANY OTHER LEGAL THEORY, AND WHETHER OR NOT WE HAVE BEEN ADVISED OF THE POSSIBILITY OF SUCH DAMAGES.
TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, THE TOTAL AGGREGATE LIABILITY OF THE SERVANT RECORDINGS PARTIES TO YOU FOR ALL CLAIMS ARISING OUT OF OR IN CONNECTION WITH THESE TERMS, THE SITE, OR THE SERVICES SHALL NOT EXCEED THE AMOUNT ACTUALLY PAID BY YOU TO SERVANT RECORDINGS FOR THE SPECIFIC SERVICE GIVING RISE TO THE CLAIM DURING THE SIX (6) MONTHS IMMEDIATELY PRECEDING THE DATE OF THE CLAIM. IF YOU HAVE NOT MADE ANY PAYMENTS TO SERVANT RECORDINGS, OUR MAXIMUM AGGREGATE LIABILITY SHALL NOT EXCEED FIFTY UNITED STATES DOLLARS ($50.00).
THE SITE AND ALL SERVICES ARE PROVIDED ON AN “AS IS” AND “AS AVAILABLE” BASIS. WE MAKE NO GUARANTEES REGARDING THE UPTIME, AVAILABILITY, RELIABILITY, OR UNINTERRUPTED OPERATION OF THE SITE. THE SITE MAY BE TEMPORARILY UNAVAILABLE DUE TO MAINTENANCE, UPDATES, SERVER ISSUES, OR CIRCUMSTANCES BEYOND OUR CONTROL.
Some jurisdictions do not allow the exclusion or limitation of certain damages. In such jurisdictions, our liability shall be limited to the greatest extent permitted by law.
You agree to indemnify, defend, and hold harmless the Servant Recordings Parties from and against any and all claims, demands, actions, liabilities, losses, damages, judgments, settlements, penalties, fines, costs, and expenses (including reasonable attorneys’ fees and court costs) arising out of or in connection with: (a) your access to or use of the Site or Services; (b) your violation of these Terms or any applicable law or regulation; (c) any User Submission or other content you provide to us; (d) your infringement or misappropriation of any intellectual property or other right of any third party; (e) any dispute between you and any third party relating to the Site or Services; or (f) your negligence or willful misconduct.
We reserve the right, at our own expense, to assume the exclusive defense and control of any matter otherwise subject to indemnification by you, in which event you agree to cooperate with us in asserting any available defenses. This indemnification obligation shall survive the termination of these Terms and your use of the Site.
THE SITE AND ALL SERVICES, CONTENT, MATERIALS, INFORMATION, PRODUCTS, AND FEATURES AVAILABLE THROUGH THE SITE ARE PROVIDED “AS IS” AND “AS AVAILABLE,” WITHOUT WARRANTY OF ANY KIND, EITHER EXPRESS OR IMPLIED. TO THE FULLEST EXTENT PERMISSIBLE UNDER APPLICABLE LAW, THE SERVANT RECORDINGS PARTIES DISCLAIM ALL WARRANTIES, EXPRESS OR IMPLIED, INCLUDING BUT NOT LIMITED TO:
You acknowledge and agree that your use of the Site and Services is at your sole risk. Any music, custom recordings, or other content downloaded from or accessed through the Site is obtained at your own discretion and risk, and you are solely responsible for any damage to your computer system or mobile device or loss of data that results from such download or access.
No advice or information, whether oral or written, obtained by you from Servant Recordings or through the Site shall create any warranty not expressly stated in these Terms.
In the event of any dispute, claim, or controversy arising out of or relating to these Terms, the Site, or the Services (“Dispute”), you and Servant Recordings agree to first attempt to resolve the Dispute informally. You agree to contact us at [email protected] with a written description of the Dispute, including your name, the nature of the Dispute, and the relief you seek. We will attempt to resolve the Dispute within thirty (30) days of receiving your notice. You agree not to commence any formal proceedings (including arbitration) until the expiration of this thirty (30) day informal resolution period.
If we are unable to resolve a Dispute through informal resolution within the thirty (30) day period described above, any remaining Dispute shall be resolved exclusively through final and binding arbitration, rather than in court. Arbitration shall be administered by the American Arbitration Association (“AAA”) in accordance with its Consumer Arbitration Rules then in effect, which are available at www.adr.org. The arbitration shall be conducted by a single arbitrator selected in accordance with the AAA rules. The arbitration shall take place in the United States, and may be conducted by telephone, online (via video conference), or based solely on written submissions, as determined by the arbitrator. The arbitrator’s decision shall be final and binding on both parties, and judgment on the arbitration award may be entered in any court of competent jurisdiction.
YOU AND SERVANT RECORDINGS AGREE THAT EACH PARTY MAY BRING DISPUTES AGAINST THE OTHER ONLY IN AN INDIVIDUAL CAPACITY AND NOT AS A PLAINTIFF OR CLASS MEMBER IN ANY PURPORTED CLASS, CONSOLIDATED, OR REPRESENTATIVE ACTION OR PROCEEDING. Unless both you and Servant Recordings agree otherwise in writing, the arbitrator may not consolidate the claims of more than one person and may not otherwise preside over any form of a representative, class, or collective proceeding. If this class action waiver is found to be unenforceable, then the entirety of this arbitration provision (other than the waiver itself) shall be null and void, and the Dispute shall be resolved in a court of competent jurisdiction.
Notwithstanding the foregoing, either party may seek injunctive or other equitable relief in any court of competent jurisdiction to prevent the actual or threatened infringement, misappropriation, or violation of a party’s copyrights, trademarks, trade secrets, patents, or other intellectual property rights. Additionally, claims within the jurisdiction of a small claims court may be brought in small claims court in lieu of arbitration.
These Terms and any Dispute shall be governed by and construed in accordance with the laws of the United States of America and, to the extent applicable, the laws of the state in which Servant Recordings is principally located, without regard to conflict of law principles. The United Nations Convention on Contracts for the International Sale of Goods shall not apply to these Terms.
We reserve the right, in our sole and absolute discretion, to terminate, suspend, or restrict your access to the Site and/or any Services, in whole or in part, at any time, for any reason or no reason, with or without notice, and without liability to you. Reasons for termination may include, but are not limited to: (a) violation of these Terms; (b) conduct that we believe is harmful to other users, our business, or third parties; (c) engagement in fraudulent or illegal activity; or (d) any other reason at our sole discretion.
Upon termination, your right to access and use the Site and Services shall immediately cease. Any provisions of these Terms that by their nature should survive termination shall survive, including but not limited to Sections 3 (Intellectual Property), 6 (User Submissions), 8 (Limitation of Liability), 9 (Indemnification), 10 (Disclaimer of Warranties), 11 (Dispute Resolution), and this Section 12.
If you have a pending custom recording order at the time of termination and the termination is not due to your breach of these Terms, we will either complete the order or issue a refund at our sole discretion.
If any provision of these Terms is held by a court of competent jurisdiction or arbitrator to be invalid, illegal, or unenforceable for any reason, such provision shall be modified to the minimum extent necessary to make it valid, legal, and enforceable while preserving its original intent to the greatest extent possible. If such modification is not possible, the invalid provision shall be severed from these Terms, and the remaining provisions shall continue in full force and effect. The invalidity or unenforceability of any provision in any particular jurisdiction shall not affect the validity or enforceability of such provision in any other jurisdiction.
These Terms, together with our Privacy Policy and any other legal notices, policies, or agreements published by us on the Site, constitute the entire agreement between you and Servant Recordings with respect to the subject matter hereof and supersede all prior and contemporaneous understandings, agreements, representations, and warranties, both written and oral, regarding such subject matter. No waiver of any term or condition set forth in these Terms shall be deemed a further or continuing waiver of such term or condition or a waiver of any other term or condition, and any failure by us to assert a right or provision under these Terms shall not constitute a waiver of such right or provision.
We reserve the right to modify, amend, or replace these Terms at any time, at our sole discretion. If we make material changes to these Terms, we will update the “Effective Date” at the top of this page. We may, but are not obligated to, provide additional notice of material changes (such as a banner on the Site or an email to registered users). It is your responsibility to review these Terms periodically for changes. Your continued use of the Site or Services following the posting of revised Terms constitutes your acceptance of and agreement to the revised Terms. If you do not agree to the revised Terms, you must immediately discontinue your use of the Site and Services.
You may not assign or transfer these Terms or any of your rights or obligations hereunder, in whole or in part, without our prior written consent. We may assign or transfer these Terms, or any rights or obligations hereunder, without restriction and without notice to you.
We shall not be liable for any failure or delay in performing our obligations under these Terms where such failure or delay results from any cause beyond our reasonable control, including but not limited to acts of God, natural disasters, pandemic, epidemic, war, terrorism, civil unrest, government action, labor disputes, power failures, internet disruptions, or any other event beyond our reasonable control.
These Terms are for the sole benefit of you and Servant Recordings and do not create any third-party beneficiary rights.
The section headings used in these Terms are for convenience only and shall not affect the interpretation of these Terms.
By using the Site, you consent to receiving electronic communications from us. You agree that all agreements, notices, disclosures, and other communications that we provide to you electronically satisfy any legal requirement that such communications be in writing.
